Aims:
The Adults with Incapacity (Scotland) 2000 Act created the Office of the Public Guardian (OPG) in Scotland. The OPG has a general function to supervise individuals who have been appointed to manage the financial or property affairs of adults who lack the capacity to do so for themselves.
Services provided:
- Provide general information, advice and guidance with regard to Powers of Attorney; Access to Funds; Guardianship and Intervention Orders; and investigations.
- Register continuing and / or welfare powers of attorney that meet registration criteria.
- Maintain a public register of all continuing powers of attorneys and welfare powers of attorney drawn up after April 2001, all withdrawers appointed under the access to funds scheme and all guardians and interveners appointed after April 2002
- Investigate concerns where the property or financial affairs of an incapable adult seem to be at risk.
- Supervise the actions of withdrawers appointed under the access to funds scheme.
- Supervise all financial guardians and interveners appointed by the courts.

The Office of the Public Guardian is part of the Scottish Courts and Tribunals Service. They can provide general information and guidance on financial provisions of the Adults with Incapacity (Scotland) Act 2000. However, if legal advice is required clients may wish to contact a legal adviser. Please note that as welfare or healthcare related matters do not fall under the remit of the OPG they are unable to assist with these types of enquiries.
