Office of the Public Guardian (Scotland)

Provides a registration service for continuing and /or welfare powers of attorney and supervise individuals who have been appointed to manage the financial or property affairs of adults who lack the capacity to do so for themselves

Aims:

The Office of the Public Guardian (OPG) in Scotland has a general function to supervise those individuals who have been appointed to manage the financial or property affairs of adults who lack the capacity to do so for themselves.

Services provided:

  • Provide information, advice and guidance with regard to Powers of Attorney; Access to Funds; Guardianship and Intervention Orders; and investigations.
  • Register continuing and / or welfare powers of attorney that meet registration critera.
  • Maintain a Public Register of all continuing powers of attorneys, and welfare powers of attorney drawn up after April 2001, all withdrawers appointed under the access to funds scheme and all guardians and interveners appointed by the courts after April 2002
  • Investigate concerns where the property or financial affairs of an adult seem to be at risk.
  • Supervise the actions of withdrawers appointed under the access to funds scheme.
  • Supervise all financial guardians and interveners appointed by the courts.

Opening hours:

Monday – Friday, 9.00am – 5.00pm.

Additional information:

The Office of the Public Guardian is part of the Scottish Courts and Tribunals Service.  They can provide information and guidance on the Adults with Incapacity (Scotland) Act 2000.  However, if legal advice is required clients may wish to contact a legal adviser.
